1. Introduction
These Terms and Conditions (“Terms”) govern access to and use of the
saunacask.com website (“Site”), and the purchase of any products (“Products”) offered by Sauna Cask (“we”, “us”, or “our”). By using our Site or purchasing Products, you agree to these Terms.
2. Orders and Payment
- All orders are subject to availability and acceptance.
- Prices are displayed in Canadian dollars unless otherwise stated and do not include applicable taxes.
- Payment must be completed using one of the methods offered at checkout.
- We reserve the right to change pricing or correct errors in listing at any time.
3. Shipping and Delivery
- We deliver Products to addresses within Canada. Shipping fees and estimated delivery times are shown at checkout.
- Delivery times are estimates and not guaranteed.
- Title and risk pass to the customer upon shipment.
4. Cancellations and Returns
- Unless you placed a Customized order, you may cancel a Sauna order up to 14 Days before delivery or shipping for a full refund.
- Returns are accepted within 14 days of delivery for unused, unopened products. You are responsible for return shipping.
- Damaged or defective Products must be reported within 3 days of delivery for exchange or refund.
5. Product Warranty
- Our product includes a 1-year limited warranty against defects in materials and workmanship for residential use only. The warranty applies only to original purchasers of Sauna Cask and Plunge products bought directly from SaunaCask.com or authorized sellers and covers major structural components and core systems (including sauna structures, heaters, cold plunge tubs, chillers, and control systems) under normal, intended use. Warranty claims must be submitted with proof of purchase and photos or video of the issue, and Sauna Cask will, at its discretion, repair, replace, or provide a credit for the affected component or product, excluding labour, installation, and shipping costs.
- This warranty does not cover damage caused by improper installation, misuse, neglect, alterations, commercial or rental use, inadequate maintenance, electrical issues outside the product, cosmetic wear, or normal wear-and-tear consumables such as filters, gaskets, seals, and sauna stones. The warranty is void if non-approved modifications or repairs are made, if the product is not installed or used according to instructions, or if damage arises from environmental factors such as flooding, pests, or extreme weather. Liability under this warranty is limited to the original purchase price of the product and does not extend to incidental or consequential damages, to the extent permitted by applicable Canadian law, and any statutory rights you have under provincial or federal consumer protection laws remain in effect.
6. Use of the Site
- The Site and content are for your personal, non-commercial use only.
- Prohibited activities include hacking, unauthorized data scraping, misuse of the Site for fraudulent purposes, or infringing on the intellectual property of Sauna Cask or others.
7. Intellectual Property
- All content, trademarks, and images on this Site are the property of Sauna Cask or its licensors and protected by Canadian and international laws.
- Copying, distribution, or use without permission is prohibited.
8. Limitation of Liability
- To the fullest extent permitted by law, Sauna Cask is not liable for direct, indirect, incidental, special, or consequential damages arising from the use of the Site or Products.
- Our maximum liability is limited to the purchase price paid for any Product.
